Terms of Service
These Terms of Service ("Terms") govern your use of the OpenWebTrack cloud-hosted service operated by OpenWebTrack ("we", "us", or "our"). By creating an account or using the service, you agree to these Terms.
1. The service
OpenWebTrack Cloud is a managed, cloud-hosted version of the open-source OpenWebTrack analytics platform. The software is licensed under AGPL-3.0 and remains free for self-hosting; these Terms apply only to the hosted service we operate on your behalf.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the service. If you accept these Terms on behalf of an organisation, you represent that you have authority to bind it.
3. Your account
- You are responsible for keeping your credentials secure and for activity under your account.
- Provide accurate information when registering and keep it up to date.
- Notify us promptly at support@openwebtrack.com if you suspect unauthorised access.
4. Acceptable use
You agree not to:
- Track visitors without a lawful basis under applicable privacy law (see our Privacy Policy).
- Inject the OpenWebTrack script into sites you do not own or are not authorised to operate.
- Use the service to process personal data outside the scope defined in your configuration.
- Reverse-engineer, resell or attempt to extract our source code beyond what AGPL-3.0 allows.
- Interfere with the service, other customers, or attempt to bypass usage limits.
5. Plans, fees and billing
- Plans are billed monthly or yearly in advance. Prices are listed on the pricing page.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You authorise us to charge your saved payment method. Failed charges may suspend the service after a grace period.
- Fees are non-refundable except where required by law. We may offer pro-rated refunds at our discretion.
- We reserve the right to change prices with at least 30 days' notice for the next billing period.
6. Free trial
The cloud plan may start with a 7-day free trial. No charges apply during the trial unless you upgrade. If you do not cancel before the trial ends, your saved payment method will be charged.
7. Data and ownership
- You retain all rights to the analytics data you collect through your websites.
- You can export or delete your data at any time from the dashboard.
- We may process your data only as described in our Privacy Policy and your configuration.
8. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates or emergency fixes that cause temporary downtime. Status information is published at our status page (if available).
9. Suspension and termination
We may suspend or terminate your account if you breach these Terms, fail to pay, or pose a security risk. You may cancel at any time from the dashboard. On termination we will export or delete your data as you request, subject to legal retention obligations.
10. Open source
The OpenWebTrack software is open source under AGPL-3.0. These Terms only cover the hosted service. You may fork and self-host the same software at any time under the upstream licence.
11. Disclaimers and liability
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied. Our aggregate liability arising from or related to the service is limited to the amount you paid us in the 12 months before the claim, or €100, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the service, your websites, or your breach of these Terms, to the extent permitted by law.
13. Changes
We may update these Terms from time to time. Material changes will be announced by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction where our hosting entity is registered (to be confirmed at company formation). If you are a consumer in the EU, you also benefit from the mandatory consumer protection laws of your country of residence.
